By making a reservation through our website, Bookeo, email, telephone, WhatsApp, a third-party marketplace, or in person, you confirm that you have read, understood, and agreed to these Terms and Conditions.
If you make a reservation on behalf of other participants, you are responsible for ensuring that every participant receives and understands the applicable terms, requirements, and activity information.

Our diving and marine activities are subject to weather, sea conditions, participant experience, equipment availability, minimum participation requirements, and instructions issued by the local Port Authority.
2. Reservations and Booking Confirmation
A reservation is confirmed only after the required deposit or full payment has been received and a confirmation has been issued.
Submitting a contact form, requesting availability, or receiving a preliminary itinerary does not guarantee a reservation.
Unless otherwise stated in writing:
- A deposit may be required to secure a reservation.
- The remaining balance is due on or before the scheduled activity.
- Availability is subject to change until payment is received.
- Prices are listed in United States dollars unless otherwise indicated.
- Participants are responsible for reviewing the booking confirmation and reporting errors promptly.
- Special requests are not guaranteed unless confirmed in writing.
Aqua Adventures Eco Divers may decline or cancel a reservation if required information or payment is not provided.
3. Third-Party Reservations
Reservations made through Viator, Tripadvisor, PADI, Bookeo, travel agents, hotels, online marketplaces, or other third-party providers may be subject to the provider’s own terms, payment procedures, cancellation deadlines, commissions, and refund policies.
When a reservation is made through a third party:
- Changes and cancellations may need to be requested directly through that provider.
- Refunds may be processed by the provider rather than Aqua Adventures Eco Divers.
- The amount paid to the provider may differ from our direct booking price.
- We are not responsible for platform fees, currency conversion charges, or delays caused by the provider.
If these Terms and Conditions conflict with the confirmed terms of a third-party reservation, the terms shown in the applicable booking confirmation may control the payment and cancellation process.
4. Prices and Payments
The price displayed at the time of booking applies to the services listed in the confirmation.
Unless specifically stated as included, prices may not include:
- Scuba equipment rental
- Marine park fees or bracelets
- Transportation
- Photographs or videos
- Private instructors or guides
- Private boats
- PADI eLearning materials
- Certification fees
- Additional dives
- Gratuities
- Third-party booking or payment fees
Participants are responsible for checking what is included before completing payment.
We may accept payment through Bookeo, credit or debit card processors, electronic payment services, bank transfers, cash, or other approved methods.
Full payment must be completed before participation unless another arrangement has been confirmed in writing.
5. Cancellations, Changes, and Refunds
Cancellation and refund eligibility depends on the type of activity, the time the cancellation is received, services already provided, and the terms shown in the booking confirmation.
Fun Dives, Snorkeling, and Regular Excursions
Unless a different cancellation policy appears in the booking confirmation:
- Cancellation requests should be received at least 24 hours before the scheduled activity.
- Late cancellations made within 24 hours of departure may be non-refundable.
- No-shows are non-refundable.
- Arriving too late to participate may be treated as a no-show.
- Unused portions of an activity are not refundable once the activity has started.
Requests must be received during reasonable local business hours. Sending a message does not automatically confirm that a reservation has been canceled. We recommend obtaining written confirmation from our team.
Courses and Training Programs
Course deposits, PADI eLearning, digital materials, certification processing, and other training materials may become non-refundable once purchased, issued, assigned, or activated.
If a participant does not complete a course:
- Refunds for completed training are not guaranteed.
- Used materials and completed sessions are non-refundable.
- Additional training required to meet performance standards may involve additional charges.
- Certification cannot be issued until all performance requirements have been completed.
- Course transfers, extensions, or referral documentation are subject to instructor approval and applicable PADI standards.
Unless otherwise confirmed in writing, unused Aqua Adventures course credit may be applied within 12 months of the original booking date. PADI eLearning access and validity are governed by PADI’s applicable terms.
Whale Shark and Seasonal Tours
Whale shark tours, manta ray tours, and other seasonal activities may have special cancellation requirements due to limited availability, government regulations, boat commitments, and operating seasons.
The cancellation policy displayed on the booking confirmation applies.
Promotional and Discounted Reservations
Promotional rates, discounted reservations, packages, group rates, and special offers may be non-refundable or subject to different change conditions. Applicable restrictions will be communicated before or at the time of booking.
Refund Processing
Approved refunds will normally be returned through the original payment method when possible.
Processing times are controlled by banks, card companies, booking platforms, and payment providers. Aqua Adventures Eco Divers is not responsible for delays after an approved refund has been submitted.
Currency conversion differences, banking charges, platform commissions, and non-refundable payment fees may affect the final amount received.
6. Participant Minimums
Some activities require a minimum number of participants to operate safely and economically.
Minimums may include:
- Two participants for certain local, non-drift dives
- Four participants for distant dive sites, drift dives, wreck dives, or night dives
- Other minimums communicated for a specific tour, course, or charter
If the required minimum is not reached, Aqua Adventures Eco Divers may:
- Offer an alternative time or date
- Offer different dive sites
- Combine compatible reservations
- Offer an available alternative activity
- Provide a credit
- Issue a refund when rescheduling or an appropriate alternative is not possible
We will make reasonable efforts to communicate changes as early as possible.
7. Weather, Sea Conditions, and Port Closures
All marine activities depend on weather, sea conditions, currents, visibility, and instructions issued by the Capitanía de Puerto or other authorities.
Safety decisions are made by Aqua Adventures Eco Divers, the captain, instructor, guide, and applicable authorities.
We reserve the right to:
- Delay departure
- Change departure time
- Change the boat
- Change dive or snorkeling sites
- Reduce or modify an itinerary
- Reschedule an activity
- Cancel an activity
- Refuse to enter an area considered unsafe
If the Port Authority officially closes the port or conditions prevent an activity from operating safely, we will attempt to reschedule the reservation.
When rescheduling is not possible, an appropriate credit or refund may be offered based on the services provided, costs already incurred, and the terms of the reservation.
Clouds, rain, reduced visibility, current, waves, marine life movement, or personal discomfort do not automatically qualify a participant for a refund when the activity can still operate safely.
8. Changes to Dive Sites and Itineraries
Specific dive sites, routes, depths, marine life encounters, and underwater conditions cannot be guaranteed.
Dive site selection may depend on:
- Weather and sea conditions
- Currents and visibility
- Port Authority restrictions
- Participant certification levels
- Participant age
- Recent diving experience
- Group comfort and skill level
- Boat availability
- Operational and safety considerations
- Instructor and captain judgment
A requested dive site may be replaced with another suitable location without creating an automatic right to a refund.
The final decision regarding sites and itineraries belongs to the captain, instructor, guide, and Aqua Adventures Eco Divers.
9. Whale Shark Tours and Wildlife Encounters
Whale sharks, manta rays, turtles, dolphins, sharks, and other marine animals are wild animals in their natural environment.
Aqua Adventures Eco Divers cannot guarantee:
- Whale shark sightings
- Manta ray sightings
- The number of animals present
- The length of an encounter
- Water visibility
- The number of permitted water entries
- Specific marine life behavior
- Photographic or video opportunities
Tour procedures and water-entry limits may be controlled by government regulations, environmental rules, sea conditions, and instructions from authorized guides.
Failure to see a whale shark or another species does not automatically qualify a participant for a free second tour or refund when the scheduled tour was operated.
Participants must follow all wildlife interaction rules and guide instructions.
10. Certification and Diving Experience
Certified divers must provide valid proof of certification from a recognized training agency.
Each diver is responsible for:
- Diving within their certification and experience limits
- Providing accurate information about their certification
- Disclosing the date of their most recent dive
- Providing an accurate number of logged dives
- Following the dive plan
- Monitoring depth, air supply, and no-decompression limits
- Using appropriate equipment
- Following instructor, Divemaster, guide, and captain instructions
Aqua Adventures Eco Divers may recommend or require:
- A refresher program
- Confined-water practice
- A private guide
- A shallower dive
- A different dive site
- Additional training
- Cancellation of participation
These decisions may be based on inactivity, limited experience, unsafe behavior, difficulty completing skills, medical concerns, poor buoyancy control, anxiety, or inability to follow instructions.
Misrepresenting certification, medical fitness, experience, age, or ability may result in removal from the activity without a refund.
11. PADI Courses and Certification
PADI certification is earned by meeting required performance standards. Payment for a course does not guarantee certification.
Students must successfully complete all required:
- Knowledge development
- PADI eLearning
- Confined-water training
- Open-water dives
- Skills and performance requirements
- Medical and administrative documentation
Instructors cannot remove, ignore, or reduce required standards.
Additional training may be required when a student needs more time to meet performance requirements. Additional sessions, boat trips, equipment rental, instructor time, or other services may involve additional charges.
Aqua Adventures Eco Divers may withhold certification if requirements have not been completed or if issuing certification would violate PADI standards or create a safety concern.
12. Medical Requirements
Scuba diving and marine activities can be physically demanding.
Participants may be required to complete a medical questionnaire before participating.
If any response requires medical approval, the participant must provide appropriate written clearance from a physician before diving.
Participants are responsible for:
- Answering medical questions honestly
- Disclosing relevant conditions when required
- Obtaining medical clearance when indicated
- Informing the instructor of changes affecting fitness to dive
- Avoiding alcohol, drugs, or medication that may impair safe participation
Aqua Adventures Eco Divers may deny participation when a participant appears medically unfit, intoxicated, impaired, or otherwise unable to participate safely.
A participant who cannot participate because required medical clearance was not obtained may not be eligible for a refund.
A medical questionnaire or physician clearance does not eliminate the inherent risks associated with scuba diving.
13. Minors
Participants under 18 years of age require the authorization of a parent or legal guardian.
A parent or legal guardian may be required to:
- Complete the reservation
- Sign liability releases and medical forms
- Approve training and participation
- Provide emergency contact information
- Remain available during the activity
Minimum ages, depth limits, supervision requirements, and activity restrictions are governed by PADI standards, applicable regulations, and Aqua Adventures safety policies.
A child’s age and certification level may limit available courses, depths, dive sites, or activities.
14. Participant Conduct and Safety
All participants must follow instructions provided by the captain, instructor, Divemaster, guide, and crew.
We may refuse or terminate participation when a person:
- Behaves dangerously or aggressively
- Harasses staff or other guests
- Ignores safety instructions
- Damages marine life or the environment
- Appears intoxicated or impaired
- Provides false medical or certification information
- Uses equipment irresponsibly
- Places themselves or others at risk
- Interferes with the safe operation of the boat or activity
Removal for unsafe or inappropriate conduct does not create an automatic right to a refund.
15. Alcohol, Drugs, and Fitness to Participate
Participants must not dive or join a marine activity while impaired by alcohol, recreational drugs, or any substance that may affect judgment, coordination, breathing, consciousness, or physical ability.
Participants are responsible for ensuring they are:
- Properly rested
- Adequately hydrated
- Physically able to participate
- Free from impairment
- Able to understand and follow instructions
Aqua Adventures Eco Divers may refuse participation when impairment or poor physical condition creates a safety concern.
16. Flying After Diving
Participants are responsible for allowing an appropriate surface interval before flying or traveling to altitude.
Aqua Adventures Eco Divers generally recommends waiting at least 18 hours after completing multiple dives before flying. A longer interval may be appropriate depending on the diving profile, applicable guidance, and personal circumstances.
Each participant is responsible for planning flights and travel accordingly. Missing a scheduled dive because of flight arrangements does not create an automatic right to a refund.
17. Equipment Rental
Rental equipment must be used responsibly and returned in the condition in which it was provided, allowing for reasonable normal wear.
Participants must:
- Inspect and test rental equipment before entering the water
- Report concerns immediately
- Use equipment only as instructed
- Avoid leaving equipment unattended
- Return all items after the activity
Participants may be charged for:
- Lost equipment
- Missing accessories
- Damage caused by negligence
- Damage caused by misuse
- Failure to return rental items
A participant should not use any equipment that appears unsuitable or defective. Concerns must be reported to the instructor or staff before the dive.
18. Personal Equipment and Belongings
Participants who bring personal equipment are responsible for its condition, compatibility, maintenance, and correct use.
Aqua Adventures Eco Divers is not responsible for loss or damage to personal belongings except where liability cannot legally be excluded.
We recommend leaving unnecessary valuables at your accommodation and protecting phones, cameras, computers, and other sensitive equipment from water.
Items left at the dive center, dock, boat, vehicle, or activity location are left at the participant’s own risk.
19. Transportation and Arrival
Participants are responsible for arriving at the confirmed meeting point by the stated check-in time.
Transportation arrangements, ferry schedules, traffic, weather, parking, hotel delays, and missed connections should be considered when planning arrival.
We are not responsible for a participant missing an activity because of:
- Ferry delays
- Traffic
- Incorrect directions
- Hotel transportation
- Missed flights
- Personal scheduling errors
- Failure to review the confirmation
- Late arrival
Transportation is included only when specifically stated in the booking confirmation.
Any transportation arranged through a third-party provider may be subject to that provider’s terms and availability.
20. Assumption of Risk and Liability Forms
Scuba diving, snorkeling, boating, swimming, wildlife encounters, and marine excursions involve inherent risks.
These risks may include:
- Decompression illness
- Barotrauma
- Drowning
- Breathing gas emergencies
- Equipment failure
- Slips, falls, and boat movement
- Currents, waves, and changing weather
- Marine life encounters
- Physical exertion
- Transportation-related incidents
- Serious injury or death
All participants must complete and sign applicable liability releases, assumption-of-risk agreements, medical statements, and safe-diving forms before participating.
Refusal to complete required documentation will prevent participation and may not qualify for a refund.
Nothing in these Terms and Conditions excludes liability that cannot legally be excluded under applicable law.
21. Emergency Assistance
In an emergency, Aqua Adventures Eco Divers may take reasonable action considered necessary to protect a participant’s health or safety.
This may include:
- Providing first aid or oxygen
- Contacting emergency services
- Arranging transportation
- Sharing necessary information with medical professionals
- Ending or changing an activity
- Returning to shore
Participants are responsible for medical, evacuation, transportation, hospital, recompression, and other emergency expenses not covered by Aqua Adventures Eco Divers.
Travel and diving insurance are strongly recommended.
22. Photography and Media
Photographs or videos may be taken during activities.
Optional photo or video services may be provided by crew members or independent providers. Unless specifically included in the booking, these services may involve an additional charge.
Photo and video results cannot be guaranteed because of visibility, sea conditions, equipment issues, participant positioning, marine life behavior, or other circumstances.
Aqua Adventures Eco Divers may request permission to use images for promotional purposes. Participants who do not wish to appear in promotional content should notify us in writing before the activity.
For more information about personal data and photographs, please review our Privacy Policy.
23. Force Majeure
Aqua Adventures Eco Divers is not responsible for failure, interruption, delay, or changes caused by circumstances beyond our reasonable control.
These may include:

- Hurricanes or tropical storms
- Port closures
- Natural disasters
- Government restrictions
- Public health emergencies
- Civil disturbances
- Transportation interruptions
- Fuel or supply shortages
- Mechanical emergencies
- Utility or communication failures
- Actions of third-party operators
- Other extraordinary events
When possible, we will offer reasonable alternatives in accordance with the circumstances and applicable booking terms.
24. Complaints and Service Concerns

Concerns regarding service, equipment, staff, charges, or reservations should be sent to:
Please include:
- Booking name

Please review our Privacy Policy before making a reservation.

27. Changes to These Terms
Aqua Adventures Eco Divers may update these Terms and Conditions to reflect changes in operations, services, regulations, safety procedures, or legal requirements.
The version in effect when a reservation is made will generally apply to that reservation unless a change is required by law, safety considerations, government instruction, or mutual written agreement.
The most recent version will be published on this page with an updated revision date.
28. Severability
If any part of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
Failure to enforce a provision on one occasion does not waive the right to enforce it later.
29. Governing Law and Jurisdiction
These Terms and Conditions are governed by the applicable laws of Mexico.
Any dispute arising from services provided by Aqua Adventures Eco Divers will be subject to the competent authorities and courts of Quintana Roo, Mexico, except where applicable consumer law requires otherwise.
